Definition of the terms

Personal data means information or a set of information about an individual who is identified or can be specifically identified.

The personal data controller is an individual or legal entity that determines the purpose of personal data processing, establishes the composition of this data and the procedures for its processing, unless otherwise provided by law.

The processing of personal data means any action or set of actions, such as collection, registration, accumulation, storage, adaptation, modification, updating, use and dissemination (distribution, sale, transfer), depersonalisation, destruction of personal data, including with the use of information (automated) systems.

The personal data controller means an individual or legal entity that is authorised by the personal data controller or by law to process this data on behalf of the controller.

The consent of the personal data subject means the voluntary expression of the will of an individual subject (to his/her awareness) to grant permission to process his/her personal data in accordance with the formulated purpose of their processing, expressed in the form of a mark on familiarisation with this Privacy Policy and the processing of personal data (hereinafter referred to as the Privacy Policy).

1. Consent to data processing

By using the Website located at: https://datapark.ua (hereinafter referred to as the Website), you confirm and warrant that:

• you have read, understood and agree to be bound by this Privacy Policy;
• you are at least eighteen (18) years old (or your parent, guardian or legal representative has read and agrees to this Privacy Policy on your behalf).

If you do not agree to this Privacy Policy, you may not use the Website. In this case, you must:

This Privacy Policy regulates the collection and use of personal data that may be requested/received when using the Website of ANTE MEDIAM LLC, including filling in registration forms, the ticket system https://ticket.datapark.com.ua/, by telephone or in messengers/social networks (Viber, Telegram, Facebook), etc. for the purposes of processing personal data as described above.

2. Scope of personal data

When you access our Website, we automatically collect cookies, IP address, information about your interaction with the Website, such as browser type, system language, etc. from your device.

We need this data in order to provide our products and services and for the analysis of the use of our Website.

By filling in the registration form, you provide your personal data for processing, including your name, surname and patronymic, address, place of residence (registration), email address, telephone number, education, profession, etc.

We only receive such data from individuals who provide it knowingly and willingly.

We collect personal data that:

• You provide to us voluntarily when filling out the registration form, during communication by telephone or in messengers/social networks (Instagram, Viber, Facebook, Telegram) and other channels, namely: name, surname and patronymic, address, place of residence (registration), email address, telephone number, information about education, profession and other data that is openly requested.
• data that we receive automatically: cookies, logging of the pages you have viewed, the functions and content you interact with, how long you stay and how often you use the Website and other information about the use of the Website.

We do not process special (sensitive) categories of data, such as racial or ethnic origin, political, religious or ideological beliefs, membership in political parties or trade unions, criminal convictions, as well as data concerning health, sexual life, biometric or genetic data, etc.

In this regard, you should carefully read your rights and obligations regarding the processing of personal data, which are specified in Article 8 of the Law of Ukraine “On Personal Data Protection”. You should carefully read this Privacy Policy and express your full consent to its terms.

3. Purposes of personal data processing

We may process your personal data for the following purposes (one or more purposes may apply simultaneously):

Information, consultation and ordering of services, including the sending of marketing messages. We may use your personal data to provide you with consultations, to familiarise you with the products and services of ANTE MEDIAM LLC that you have requested or to inform you of new products and services, including by communicating with you and sending you messages.

For example, to receive additional information about our company, services and products, news, discounts, offers and other materials for marketing purposes.

You agree to receive messages of an informative or other nature in the form of SMS messages, emails, telephone calls, messages in instant messaging systems (including but not limited to Viber, WhatsApp, Telegram, Instagram), etc.

Fulfillment of contractual obligations.

We may use your personal data to enter into contracts, supplemental agreements, applications, invoicing, signing acts and other documents to comply with accounting requirements and to prepare financial statements.

We process your personal data for the purpose to respond to your requests regarding technical, financial and organisational matters, including requests submitted via the ticket system at https://ticket.datapark.com.ua/.

Evaluation and analysis of Website usage

We analyse our operations for the purpose to maintain, improve, innovate, plan, design and develop the Website, as well as for statistical analysis purposes or for other purposes that may exist to achieve the ultimate purpose of.

The types of personal data processing include their collection, registration, accumulation, storage, adaptation, modification, updating, use and dissemination (distribution, sale, transfer), depersonalisation and destruction, including with the use of information (automated) systems.

We act in compliance with this Privacy Policy, the Regulation on the processing and protection of personal data and the current legislation of Ukraine.

We have the right to store Personal Data for as long as necessary to fulfil the purpose specified in this Privacy Policy or within the terms established by the current legislation of Ukraine or until you delete this data.

4. Transfer of personal data to third parties

We do not sell, transfer or disclose the received personal data to third parties without your prior consent. We disclose personal data only in the cases determined by the current legislation of Ukraine, as well as:

• We provide information to third parties (our partners, suppliers, state and local authorities, etc.) who provide us with technical and other support, etc.
• We will disclose information at the request of the court, law enforcement and regulatory authorities and institutions or in other cases provided for by the current legislation of Ukraine.
• We will disclose information to prevent a crime or damage to us or third parties.

5. Use of Cookies

6. Age restrictions

ANTE MEDIAM LLC does not process personal data of persons under 18 years old.

7. The rights of the personal data subject in compliance with the Law of Ukraine “On the Protection of Personal Data”

The personal data subject has the right to:

1) to know about the sources of collection, location of their personal data, the purpose of their processing, location or place of residence (stay) of the owner or manager of personal data or to give a corresponding order to obtain this information to persons authorised by them, except in cases established by law;

2) to receive information on the conditions for giving access to personal data, including information about third parties to whom his/her personal data is transferred;

3) to have access to their personal data;

4) to receive a response on whether his/her personal data is processed no later than 30 calendar days from the date of receipt of the request, except in cases provided for by law, and to receive the content of such personal data;

5) to submit a reasoned request to the personal data controller with an objection to the processing of their personal data;

6) to submit a reasoned request to change or destroy their personal data by any owner and manager of personal data, if this data is processed illegally or is unreliable;

7) to protect their personal data from the illegal processing and the random loss, destruction, damage in connection with intentional hiding, failure to provide or untimely provision of their personal data, as well as to protect against the provision of information that is false or discrediting the honour, dignity and business reputation of an individual;

8) to submit complaints regarding the processing of their personal data to the Commissioner or to the court;

9) to apply legal remedies in case of a violation of the legislation on personal data protection;

10) to make reservations about the restriction of the right to process their personal data when giving consent;

11) to withdraw consent to the processing of personal data;

12) to know the mechanism of automatic processing of personal data;

13) to be protected against an automatic decision that has legal consequences for him/her.

8. Location of the personal data, place of residence (stay) of the data controller

The owner (controller) of the personal data is ANTE MEDIAM LLC (EDRPOU code – 37815293).

Personal data is stored in information (automated) systems and/or on paper carriers of ANTE MEDIAM Limited Liability Company at the address: 16a, Parkova Doroha Street, Kyiv, 01601, Ukraine

9. Ensuring the protection of personal data

We take all reasonable measures to protect data from random loss or destruction, unlawful processing, including unlawful destruction or access to personal data.

ANTE MEDIAM LLC has implemented a complex of organizational and technical measures to protect personal data, in particular, but not exclusively, in compliance with the current legislation of Ukraine:

• The Law of Ukraine “On Personal Data Protection”;
• The Law of Ukraine “On Information”;
• The Law of Ukraine “On Protection of Information in Information and Communication Systems”;
• ISO 27001:2022 Certificate – Information security management system (ISMS) Standard
• ISO/IEC 27701 Certificate
